Texas Child Support guidelines...can someone help me please?

I am in the USAF. I have been paying child support for 3 years. I was contacted today because the court is going to "review" my order to see if the mother is eligable for an increase in child support. I have researched and cannot find any current information. My questions...... I am married and have two children with my wife (the children were not here at the time of the last order) 1. So I know the courts have to consider that, but what are the guidelines/percentages? 2. What is considered income for military? (I receive BAS and BAH with my base pay. The BAH is taken directly back out because I live on base. The only thing left is my bas...which is not taxable either. Can this be considered in calculating child support? This is a very crucial question...Thanks.

  1. Well I'm kind of on both sides of this situation....I receive child support for my oldest son, but my husband pays child support for his children from a previous relationship.  It sucks that its kind of a wash out......ugh.....anyway....  What I found was that it DOES matter if the NCP (non-custodial parent) has other children.  Try this website/calculator it might help......

They don't really consider if you have kids at home or not.  My exhusband was paying support on two kids and we had one at home and when they went to review the case the judge told us both that it doesn't matter if we have 9 kids at home he is still responsibile for the other 2 not with him.  Income even when in the military is any income meaning any bonuses you recieve a year can have an affect as well.  What ever income you live off of is your income and will be considered plus what you have made in the past (considered what you are capable of making).  I would just contact the child support agency and ask them because they can give you info based on your actual case

  4. Let me start off by saying that Texas Family Court sucks to deal with.  I also can't say in regards to the military portion of your question, but I'll tell you what I know...

    They DO consider whether or not you have other children at home, but not very much.  If you have no other children that you are responsible for, you will pay 20% of your income in child support, if you have other children that you are financially responsible for you will only pay 17% child support.  That percentage is based on your GROSS income before taxes and anything else is deducted from your check.  Make sence?  Anyway, I hope this helps.
