Texas Labor Law on Illegal Immigrants?

Is it sufficient for a Texas employer to accept a Tax ID number instead of a SSN for hiring a new employee? What if this employee is an illegal immigrant and only has the Tax ID number but can't produce a work permit, green card or SSN? Can the employer get in trouble for allowing this person to work for his company?

  1. Federal Law has jurisdiction in this case....the employee must provide identification as defined on the I-9 form.

    If the person is a sub-contractor and has the proper liability insurance, tax id number and occupational licenses only then is a SS card not required.


  2. Not only can they get in trouble, but it can lead to jail time. for repeated offenses.
