Texas Speeding Ticket Question? Please Help!

I live in Texas and I just got a speeding ticket. The officer said I was going 77 in a 65...

Here is the senerio...The officer was in front of me and it was night time so I didnt realize that it as an oficer until he started breaking..he pulled over to the shoulder and I passed by him going like 60. He got behind me and I kept my speed at 60, then like 10 seconds later he put his lights on and pulled me over. he gave me a ticket for going 77 in a 65...he was a state trooper for TX. and it was in a small town between dallas and college station.

Im trying to find some loop holes to get out of paying it cuz its like $210 and im a college student and that kind of money does not come easy...

I dont remember him identfying himself...I have a radar detector and it did not alert me and its one of those GOOD ones and picks up EVERYTHING!...he said he clocked my speed from behind him and is that possible?....do they have redars in the back of their cars???....AND before he moved to the side he was in front of me doing like 80...so is it legal for him to be speeding??

Are there valid points to bring up in court and try to get my ticket dismissed??

Any help and advice would help right now!!

Thanks!

  1. Yep,they have radar in the rear of the vehicles.

How do you know he was going 80? are you a trained LEO?

If he WAS going 80, is it legal for him? yes.  While each municipality will instruct their officers as to what may be appropriate speeds for patrolling, the traffic law does state that police patrol vehicles are exempt from following the speed limit and other traffic laws.

as far as him identifying himself most likely you just didnt hear it.  Whether he did or not wont help you get out of a ticket.

as far as your radar? its not perfect.

Go for the defensive driving class.  It sounds like your best bet

  2. Check out the blog spot while you are considering your options. It will give you some really useful advice on how to behave in court if you decide to attempt to have the ticket dismissed. Good luck.

  3. go to court TELL  the truth as to what really happened do not say anything against the officer  or say anything smart to the judge be respectful

to the judge he or she may let you off with a warning or cut the ticket in half

DO NOT TELL the judge you have a radar detector  that could go against you and dress casual

  4. You could opt to take a defensive driving class.  They charge you a defensive driving fee and then you have to pay for the class plus $10 to DPS.  This will lower your insurance rates too.  Otherwise, you are probably out of luck and are taking a big chance trying to beat the ticket because if you lose, the fine could be up to $500.  Most municipal court judges are very pro-police because they deal with them everyday.  Good luck.
