Texas abortion question: can an adult take a 16 year old to a clinic?

In Texas, can an adult who is not a legal guardian take a 16 year old to get an abortion? Assume that the fetus is only 4 weeks inside the woman. Does the father have to be notified? Do they have to know who the father is?

Please, if you are anti-abortion don't waste your time. I need factual answers, not opinions.

But please, if you live in another state you can still answer.

  1. Yes I would think so,I was pregnant at 16 my step dad took me to the clinic (mom was working) I didn't go through with it,She's 9 Years old now-would have been a big mistake-but they were going to let me.If she is going to Abort the baby don't tell the dad-no point.Let he make the choice, please don't make her if she doesn't want to,can scar her for life.I was in OK When this took place.

  2. The law changed in 2005 to require parental notification...not consent.  Only one parent has to be notified.  So, if the paperwork is filled out before the procedure, someone else can drive the patient to the clinic.  There are exceptions to parental notification; BUT, that requires a judicial bypass.  That means a court hearing is involved where the patient has to prove to the judge that it would not be in her best interests to tell her parents.

"As of January 2004, the State of Texas requires abortion providers to give specific information to women 24 hours before having an abortion. This information was written by state officials not by our medical/clinical staff. This information explains the abortion procedure and risks, risks of childbirth, fetal development, alternatives to abortion and resource directory of agencies.

    INFORMATION FOR MINORS

As of September 2005 - Texas law requires parental consent before a woman under 18 years of age can obtain an abortion. A parent can accompany you to the clinic to sign the paper work or they can sign the papers at another time prior to the abortion.

There is an organization in Texas CLICK HERE - www.janesdueprocess.org that will help you through a legal process (at no charge) to have an abortion with out consent of a parent. Please call our clinic to find out more about this law."

"A judicial bypass is an order from a judge that allows a minor to have an abortion without telling or receiving consent from her parent or legal guardian. To get a judicial bypass, a judge must decide that the minor meets at least one of the following “grounds” (reasons):

The minor is mature and sufficiently well informed about her pregnancy options to make the decision without a parent or legal guardian being involved.

It is not in the minor's best interest for the parent or legal guardian to be notified.

Notification of a parent or legal guardian could lead to physical, sexual, or emotional abuse of the minor."

I don't believe the father of the fetus has to be notified.

  3. Yes you can certainly take her and just in case this helps, she can go without any adult! No, the father doesn't have to be notified.....

Look into aspiration abortion.  They can do that up until 9 weeks and it's not nearly as painful and barely any recovery time.

Good luck and she's lucky to have the support!
