i lived in texas at 8500 harwood my lease was up on june 30th i went in and gave them my keys and told them i was moving to new orleans and i had told them on the phone back in may that i was moving. Now i get a bill saying i owe the month of july because i didnt sign a piece of paper saying i was moving. My question is, Is a verbal statement the same as a signed piece of paper and how are they charging me for july when i gave them the keys at the end of my lease?? if i wanted to stay til july i would have had my lease go til july. i am just very confused about the whole situation can someone please help me out here

  1. Unless it states in the contract a verbal if given to the right person should work. Talk to the Person in charge, not just the one answering the phone or to the ower for resolution. I am an owner and have worked with people in the past. However some just walk away and not even pay what they owe. This then becomes a long drawn out expensive process. Good Luck


  2. If 30 days proper written notice was required, your verbal notice does not hold up.

    No a verbal statement is not the same as a written notice.

    You failed to properly termiate your lease and owe rent for July.

Check your lease.  It probably says that you have to give a 30 day written notice to end your lease other wise it automatically renews.  They are probably in their wrights to charge you for this.  They want the months notice to find a tenant so they don't lose a full months rent.  Sorry, and good luck.

  4. In the original lease (I'm assuming), it states that in order for either party to cancel the lease, it must be done at least 30 days prior in writing. This is standard with all apt leases. Because the original lease was in writing and both parties signed it, it takes precedence over anything verbal.

    I know that it may not make much "common sense". However, this happens everyday and this is why it is important to read the fine print of a contract.
