Question:

Texas child custody and "visitation rights" ???

I would like to know what visitation is. I understnad its every 1 3 and 5 weekend and every wed night. However. My gf, whom I live with now and have lived with for 10 months, says she moving back to her home, lubbock, and I am in texas (6 hours away).

How am I expected to travel 12 hours every other weekend orwhatever and have a fultime so I can pay child support. Does visitation mean that I have to be supervised by her ? Why cant my daughter come live with me 50% of the time or close to it. The mom has no job, I have been supporting her for the past 10 months and now she wants to move home.

My main question is about visitation and if that means I have to go to her ??? she is due in 4 weeks.

  1. Visitation is different for every child.  There is no standard visitation schedule.  A judge will order visitation based on the specific information regarding your particular case.  My ex tried to keep me in NC, but it did not work and I did move back to my home state of MO. Why would you try to make her be somewhere she doesn't want to be?  If she's going to be a good mom she has to be a happy mom.  Maybe she has more support there from family.  Pregnancy can be a very emotional time for a mom and just being home seems to help.  I do understand that you want to be apart of your childs life and I do commend you on that but you can't control her life.  Under our current visitation order, my son spends the entire summer with his dad and every other christmas, thanksgiving, new years and some spring breaks.  Doesnt' matter is she has no job, she's pregnant and will be a mom, the baby will be plenty of work for her when she arrives.    I doubt if a judge prohibits her from leaving because it's only 6 hours away, in the same state.  Think hard before giving money to an attorney, they will promise you the world and not deliver anything but an expensive bill.  Ask my ex, he's spent way to much money trying to control me, even went through a few attorneys.  I have a legal aide attorney and she won every case for me.  I have been to court hundreds of times and he never wins.  I never tried to keep his son away but an illness forced me to move back home.  Now after 8 years he has given up and now actually works with me concerning our son.  The best thing to do is work out something with your girlfriend, if you go to court the first thing the judge is going to order is mediation and if you guys don't come up with something on your own, the judge will decide and you may not like what he or she decides.  Just my thoughts.

  3. That's usually how it goes. Usually the parents meet half-way. (Check with a lawyer or court advisor)

  4. I live in TX. After my husband's children were taken out of state, we went to an attorney and found that we could've prevented it through an injunction forbidding her from leaving the area, if we'd done it BEFORE she left. So, act quickly and forbid her from leaving. It'll make all the rest as lot more manageable.
