The Father of my child refuses a paternity test just so he doesnt have to pay child support..what should i do?

  1. Contact a good lawyer...If you can prove to the court that there is a very good chance the baby is his, the courts can force him to summit to a paternity test...


  2. Get a court order.  You can make him have the test done, whether he likes it or not.

    Think about it:  if every guy who didn't want to cough up child support could just refuse a DNA test, nobody would ever have the test done.

    Give him a last chance, and say, "Look, we can do this the easy way, or we can do it the hard way.  You can go in for the test, or I can get a court order and get the system involved, and you can go in for the test.  But either way, YOU WILL HAVE THE TEST DONE!"

  3. Regardless he needs to be accountable for helping you raise your child. Call your Attorney Generals office to get that child support filed. Its free but takes awhile. He will have to take a paternity test to prove hes "not" the father in order not to pay. An atty would be faster. Some men are such idiots!!!

It does not matter if he refuses.  If he is named the father....and is the only one that is named the father they will attempt up to three times to serve him with paternity papers.  If he does not go in for the test any of these times.  He will automatically be named the father and he can not contest it cause he did not do the test when given the chance.  He will then be ordered the amount to pay and then a month or so later maybe two months you'll start getting paid.  But it will take up to a year to get the chances out of the way so it will take A LONG TIME!!!

    Then he will also owe arrears.  Don't listen to him he is just trying to bully you.

    edit* Reading all these answers is funny.  He will not go to jail for not giving a DNA sample unless you do go to a judge who could hold him in contemp of court.  But you do not need an attorney or a lawyer.  Just google "Child support division (your state)" and then get the number you need to call from there website and they will send you papers.  You just fill them out send them back and walla they do the rest.

    the majority of judges automatically rule against the father if he refuses the paternity test because by doing so, he is tacitly admitting the possibility of paternity.  all you need to do is show he's the only candidate and he's up the creek - he might even get smacked harder for being a tool.

  11. You may not even need an attorney. Contact Social Services and ask them how to file for child support. He will be subpoenaed and the judge will order DNA testing.  Once it comes back as his child, then the judge will order support.  If he doesn't show up for court or does not comply with DNA testing, the judge will order support payments in his absence as though he is the father.

    If you just want to eliminate him as the father (you had several lovers, for instance), then you would have to hire an attorney to get the dna test done.
