The Us embassy can deny a Visa to me in this case??

I'm from Nicaragua and my girfriend is from the us citizen( Native ), she went back to the us since she needs to stay there for many reasons.

She wants me to go there and we both want to marry in my country.

The deal is once married my intention is to request a Visa in the American Embassy in my country to be able to be with her.

Can they deny the Visa for some reason?

I just don't know and I'm kind of worried about it since she is making all kind of plans for both of us and she refuse to live with me in my own country.

  1. A visa is a privilege, not a right, so yes, they can deny your visa if you are found to be ineligible.

Yes they can deny the visa and often do.  it is very important for both of you to learn about the WHOLE process before starting this.  If you marry in Nicaragua,  she can thin apply for a spousal visa for you, but you cannot live in the U.S. while you wait.  It can easily take a couple of years to get the visa.  Many couples marry, thinking everything will be quick and easy, then are separated for years while they wait.  You need to learn as much as posible first...and look into a Fiance visa also.  Things will hopefully go a lot smoother if you are prepared.   I think an immigration lawyer would also be a great help if you can afford one.  The sites below have some info...and the last 2 sites are support groups for people going through the same things you are going through.  I hope you can get really good info and proceed well prepared so things will be successful.

  3. The both of you should sit down and talk about the marriage plans before acting on it. You seem to want to live in your country after the marriage. She seems to have other ideas. Talk it over as the K-1 or K-3 visa will mean that the both of you will have to wait months before being able to come to the US to marry (K-1) or to come to the US as a spouse after marriage outside the US (K-3). Don't come to the US on a tourist visa and get married. You migh complicate your chances.
