  1. you can trim any limbs over hanging on your property. go get 'em!

Just ask the neighbor if he minds if you trim the limbs that are on your property.  If he does have a problem with you trimming them, then request that he take care of it.  He may argue that he is not responsible for the limbs, in which case you would probably be ok in trimming them back to the property line.  He may be afraid to come on to your property to do the trimming.  So it sounds like you need to talk to him.  Worst case you have to do the trimming, just advise the neighbor that you are not responsible for any damge to the tree that your trimming may cause.

You say the tree is "on his side of the house," but is it on his side of the property line?  You are legally allowed to cut back any branches that are on your property, but in the interests of neighbor relations I would send him a letter telling him what your concerns are, along with photos.  Ask him to call you or come over so you can talk about it.  He really should take care of all of it if it's his tree, and having sent him the letter will protect you in the future if there is any damage.  He won't be able to say "I didn't know."

  4. You can trim anything that is on your side of the property line.Be aware that if anylimbs fall on the neighbors fence or anything on their property you are liable. If Your neighbor does't like the tree you could offer to share in the cost of removing the tree.

    However If the tree or limbs  fall on your house and does damage for any reason other then you or someone you hired  trimming it your neighbor is liable

  5. talk it over with your neighbor first. It's their tree so they should take responsibility. But if they won't listen and refuse to cut it dow, I don't think it's against the law to take matters into your own hands and cut the branches yourself.
