The building I was renting got foreclosed on....?

We were renting a tri-plex, to get into this tri-plex we had to pay $750 deposit. Last month the bank that had forclosed on the building asked us to move. We moved out yesterday, and got their "cash for keys"payment. I contacted the manager on the building and asked for our deposit back. He told me basicly, that my deposit was gone and he wasn't going to give it back. Friends are telling me to sue him and get my deposit back from him. I am having a problem with them having additional money from me, when they didn't do their part of our agreement and I did..... Do I have a case??

  1. you should have a case. normally, deposits are to be kept in an account that is just for deposits and the like. so he could be in trouble with the local laws there. i would call the local housing department to clarify, and to report him. but yeah i think you could win easily if you took him to court. so go for it a smalls claims court is pretty cheap to get started and no lawyers involved, just be sure to get as much proof as possible that it was for a deposit
