  1. Well, yes, you can sue your realtor - it's a free country, and you can sue whomever you like. That said, the amount of the earnest money or deposit given was probably clearly written into the contract you signed, as were the terms under which you woudl get to keep the deposit. Your broker did not "misrepresent" anything if they were clear about the deposit amount.

    In theory, you coudl sue the buyer for specific performance - but good luck. The success rates in those types of suitsover residential property are pitiful. There are no guarantees in real estate - it has always been and will always be an investment that involves risk.

    Why do all Americans want to sue when life throws them predictable and perfectly normal problems? Pathetic.
