If the constitutional right to privacy protects people’s right to posses obscene material in their own home (Stanley vs. Georgia), why does the right not protect a person’s choice of a sexual partner of the same gender (Bower v. Hardwick)?

  1. the Supreme Court directly overruled Bowers in Lawrence v. Texas, 539 U.S. 558 (2003), and held that such laws are unconstitutional.

    You will find that most states do not enforce laws, sexual in nature, between concenting homosexual adults in private.

    You need to contact your state Rep. and ask about this issue.

  3. The 9th amendment covers this right.
