The insurance agency closed my husband's case without my husband knowing he was in the process of suing them

can they legally just close a case with no payment made? This hasn't even gone to court yet.

  1. The ins co can close a file at any time. You need to check with your state for the Statute of Limitations. As long as a suit is filed prior to the expiration of the Statute, you're fine. As to the comment from one of the others that because you hired an attorney the case is delayed, that is absolutely incorrect, and nothing more than a cheap shot. Insurance companies have plenty of delay tactics. If you don't feel like your lawyer is doing a good job, fire him/her. The only 'bad job' is if they are not communicating with you as to the status. Insurance companies don't want you to hire lawyers because it puts you "Joe Public" on an even playing field and they lose "control." Don't worry about what the insurance company does, it means nothing.

    If it's going to court, and you have a LAWYER, well, that lawyer is probably why things are going so slowly.  Lawyers usually slow things down.

    Since you do have a lawyer, your agent, and your adjuster, can't talk to YOU any more, about the claim.  You HAVE to go through the lawyer.  So, go call your lawyer and ask.  He's going to say, yes, we're going to have to go to court.

  4. They can close the case on their end, that does mean he has to stop suing them.  Your lawyer will know how to handle it, just make them aware of the situation.
