My car was supposedly going to be fixed by a dealership. I found a guy at a body shop that could fix it for way less. So the dealership sent the check back to the insurance company and the insurance company mailed it to us. The check covered all costs with money to spare. Would i still have to pay that deductible, seeing that i got it fixed by a private body shop?

  1. If it is a final settlement cheque it is the responsibility of the company to deduct the dues, if any, before sending the cheque.

  2. Yes, If you filed a claim and the carrier paid, under the insuring agreemnt you will be required to pay the deductible.  If you dont pay the deductible, collection agent will pursue you

  3. If you are talking about health insurance, the answer is yes. You have to pay the deductible. I have had health insurance policies that paid me directly and it was up to me to pay the doctor's bill.

It is a PITA because you have to turn around and pay the doctor's bill. The insurance company pays you what they deem is the "reasonable and customary" charge less whatever deductible you have on your policy. In the end you are responsible to pay the doctor's bill.

  4. If it's your insurance company, the deductible was subtracted from the check amount.  If it's the other person's insurance, then there is no deductible for you.
