  1. It depends on which "suspect class" the person belongs to.  For example, for race, gender, religion, and national origin, Title VII of the Civil Rights Act of 1964 controls.  For age discrimination, the ADEA controls.  For disability discrimination, the ADA applies.  Not sure what you are exactly asking, but hope that helped.
