The other party's insurance doesn't want to pay the whole cost of a rental car?

My car was hit at the other driver's fault. We filed a police report where he was at 1 place. I went fixing my car trough his insurance. Their appraisor made an estimate for reparing cost. I found an auto body shop agried to fix my car for the estimate's amount. so far, so good. I needed to rent a car, so i spoke with the other party's insurance adjustor and she said they would reimburse $20 a day for a resonable time of reparing. i didn't agree with this amount, but i couldn't convince the adjustor...so the cost of the rental car was $24.99 a day. i agried to pay the difference of $4.99.my car stayed in the body shop 10 days and now the insurance company doesen't want to reimburse the whole amount for these 10 days. they said reasonable time for reparing was 6 days according to the esimate their appraisor made. in other words the whole amount plus tax was $304 and they reimburse onely $144. What would your advise be - should i and is there a way to made them pay the whole amount?

  1. That is the amount most insurance companies pay.. if you want a better car you pay the difference. I can remember when insurance didn't even pay for car rentals.. so I guess 20 dollars is better than nothing, but still doesn't cover the rental cost if you get much of a car.


  2. Ask YOUR insurance company for advice/intervention on your behalf

If the vehicle you rented was comparable to your vehicle, and the $24.99 does not include the waiver(the insurance does not have to pay that)the insurance company should be paying the difference.  If the auto body delayed the repairs, then the insurance company is not responsible for the additional 4 days.  

    You should contact the claims rep/adjuster and find out why it took 10 days to repair.  It is possible that there was a supplement.  The claims rep should then contact their appraiser and find out if the 10 days was appropriate.  

    If the claims rep does not want to do this, politely ask to speak to a supervisor.  The supervisor will assist you, and you will likely be reimbursed.  Claims reps can some times be overly aggressive in the resolution of minor property damage claims.

  5. Sadly you don't have much of a choice.  Some time you can negotiate with the BODY SHOP so they pick up the diff.

    It makes the work faster, or just jack up the repair estimate.  Beside they are making the money so they can afford to take a little bit of a loss.

  6. If you already signed papers agreeing to it, you are screwed.  If not, sign nothing and pay the money for your car and for the rental car and take him to small claims court and have him pay you.
