The police just wlked in???

they didnt hav no search warrants. their excuse was that there might been an assault. we were just innocently cleaning the room. is this a violation. can this b brought to court? i feel violated and tht they illegaly searched the house

  1. If the officers can articulate why they believed an assault had occurred there is zero reason for them to have a warrant.

    So, no violation, no you can't "bring it to court" whatever that means.


  2. It sounds like here was something that they heard from the neighbors or they heard that sounded like an assault was taking place. I wonder what they heard or thought they heard to do that.

If there is anything that can be construed as an indicator of a situation, the police can enter.  Loud noises, arguments, smells, all of these can be used.    Even if a neighbor calls in a report of an argument.  They will often search the house to make sure that the people in the entry are not under duress.  Anything in plain sight is fair game.

I am sure there is more to the story.  If they believe a person is in trouble they may enter and search for that person without a warrant.  Also they may search the immediate area around any indiiduals without a warrant for weapons...if they find something else they seize all in the house, stop searching, and wait for a search warrant to search everything and anything.  So no they did nothing wrong.

  8. violated your rights to the fullest,unless they visioned someone getting abused they can't just come in your house..the police break the laws all the time though,especially in philly,pa that's where im from.

  10. Nope.  They wouldn't come in if they didn't have a reason.  Police can come in at any time without a search warrant.
