The punishment of someone who is accused of aggr.battery but didnt start it and was harmed as badly as victim?

The accused had surgery, and the "victim" had a few stabbings. The victim came to the accused home and had sent threats via texts and myspace. The accused showed up to a different location with intent of a verbal settlement but ended up engaging in this fight after the victim struck the accused while he/she was sittin in the car.

Sounds to me like the "victim" and the "accused" have some serious growing up to do!

When someone has to resort to violence instead of talking out an issue...there are problems.

As a minimum...whomever is found guilty could face court costs and fines, have to pay any restitution for medical bills and possibly pain and suffering, probation if not actually serve time, and have a criminal record!
