Question:

There's no way they can take away our guns....right?

i always hear how people are gonna take everyone's guns and everything. there's no possible way that can happen because of the 2nd amendment? The 2nd amendment can't be changed right?

  1. Amendments have been changed before... The women voting, and prohibition. I wouldn't put it past the government.

Yes, amendments can be changed.  Notice the repeal of prohibition.  I see the problem with the gun folks differently than you.  You say you want to keep the guns for the law abiding folks, and away from criminals, but then you say that if you don't like the law, you will use the gun.  Therefore, you are a criminal.  See the paradox?

Amendments can be changed.  Thats what an amendment is, a change in something.  However, i dont expect this to ever happen, but i do expect higher and tighter control on it.  And if your guns are used for illegal purposes or obtained through illegal activity, yes they can take away your firearms.  Look at felons... most felons are not allowed to have a firearm.

  5. The only way it could be changed, especially after the Supreme Court decision a few months ago, would be through a Constitutional Amendment, which would never pass, or at least not in the next 100 years or more.

  6. Amendments to the constitution can be changed, just like anything else in the constitution. It takes a new amendment to change an old one. It's only happened once before when the amendment prohibiting alcohol was repealed.

    Amendments to the constitution are extraordinary. It's only happend 17 times since the bill of rights (1st 10 amendments). It would be especially hard to get an amendment through that changes the bill of rights, which includes the 2nd amendment. I think it should be repealed personally, but it's not going to happen any time in the next few decades, if ever.

    Interpretation also changes with the Supreme Court. Decades ago, the Supreme Court gave a very narrow interpretation of the 2nd amendment, allowing virtually any gun control laws. A few months age, the Court reversed direction and offered a much broader view, throwing out the DC gun control laws. It's unclear what will happen going forward, but it seems unlikely this new precedent will change any time soon, regardless of potential changes in the Court in the near future.

    So you're guns are safe for the next few decades at least. I think we're all less safe because of it, but many (I'm guessing including you) disagree with me.

  7. Your right to bear arms can be severely restricted by an activist Supreme or State court.  Unfortunately, gun laws tend to hurt the law-abiding much more than the criminals.

    What the activists don't seem to get is that when you take the guns away from the law-abiding, then only the criminals will have guns (and maybe the police).  The criminals aren't going to say "Oh, it's illegal?  Then I'll get rid of my gun."

  8. Technically they could, the first poster said it right. However if they did attempt that, it would probably lead to a Second Civil War.
