Question:

There is an oil well in my ranch, the operator has mineral rights & easement. there is oil leak. what can I do

Oil well is poorly maintained with missing bolts. The well has no fence of any kind around it to protect my children.

  1. yeah definitely get you a lawyer !


  2. You can sue them, and also contact the EPA.  The Environmental Protection Agency.  They will most likely come to your home and inspect.

  3. Sue them for damaging your property.

  4. It is unlikely that you can compel fences. You can provide fences so long as you do not interfere with operator's  easement rights.

    You can require operator to clean up the property, and can have the property cleaned and sue operator for costs. However be careful of incurring costs that could not be recovered if the operator abandons the  property.

  5. Go to the City or County and find out what you can do.  See if you can speak to someone who works in conjunction with the County to protect property from hazardous waste. You would think that there are laws prohibiting Oil Company's from contaminating property.  Where would you call if you were to report a hazardous waste spill in your area?  The only Lawyer I would employee would be one who will sue this Oil Well Owner for the damages to your property.  DO NOT PAY AN ATTORNEY.  You should have a case and it should be taken on a contingency bases.

  6. Laws are different in every state. Need to talk to a Lawyer , especially to protect your children...

  7. Get a bucket!
