They're trying to take my vacation days since I took a maternity leave?

I took six weeks, the bare minimum, of maternity leave this year. I also took a good number of sick days. The sick days were paid, unless they reached out of control, and they never did apparently. I also worked six weeks of half day where I was SUPPOSED to be getting paid 1/2 salary, but they didn't, and my boss even knew but said maybe our HR Manager was being 'generous'. Well! I also got paid for the mat. leave, even though only two weeks was supposed to be paid. I haven't brought it up, because you figure they would realize this! However, now I am swamped with appointments for my daughter and I, and I want to use my 10 days of vacation for any that are upcoming to avoid friction at work. Well my 'boss' said I need to talk to HR who then said he needed to discuss it with my boss. When in reality my boss is just an office manager, not the go to person with complaints. I feel as though more people in this company know about my business than should, and also that I am being cheated out of my vacation days. They wanted me to use them for part of my mat. leave to get paid more but why would I do that? I'd get six weeks mat. leave and then no vacay, and in reality I'm already entitled to six full weeks... then vacation! So I'm not sure what is going on or what I should do.

All I can say is that your a lucky gal...I had only one week of vaca and my boss took it away from me for all my appts.  I get paid to take off for them but I had to sacrifice the vaca and sick days.  I went to work sick (when I was) and still go in sick.  I dont get paid mat leav either not one single day...so I will only be taking of 4 weeks and working part time the other two weeks.  I wont be able to take off for any docs appts for the most part b/c my boss has already told me no and I havent even had my baby yet!  Id suck it up and tell them you have to take your daughter to the doc and see what happens.  I can only make my docs appts on tues wed and thurs also and I have to call my boss before I leave the dr office to make sure he doesnt have plans on the day I have my appt.  


  2. they HAVE to let you have 6 full weeks of maternity after the baby is born, they can not legally make you use your vacation days for some of it unless you are planning to take more than those 6 weeks. Tell them it's illegal and you will take action if they don't wise up.  

  3. Well get them both together so they can stop pointing fingers at who you should talk to. Then let them know that you didn't want to use your vacay days for mat. leave...But since you got paid for alot more than you "technically" should have, I wouldn't rock the boat..

    Consider yourself lucky, I get 6 weeks of UNPAID maternity leave..and they asked me to come back after 4. You sound like you got a sweet deal!

  4. you say you got paid for for maternity leave when you weren;t supposed to - they probably took it out of your vacation time - make you doctors appts for evenings or weekend. I've never heard of any law requiring a person to be PAID for maternity leave - not in Penna. or new jersey where my companies employees live

  5. If you are in the usa....FMLA....GET A LAWYER.
