I bought items in both New Look & M&S at the end of Sept, but hav never worn either item. I tried returning them today (I hav the receipts for both); M&S gave me a refund without question. However New Look said because I'd left it longer than 28 days, they couldn't refund, they could only exchange for at the till price..the item was £20 but the till price was £7!

Surely this can't be legal??

  1. In America, with receipts, you usually have 30 days to get an equal refund in monetary form, it may be different where you live though.

  3. nah it's legal. it's probably printed on the back of their receipts or otherwise posted in their store. It's fairly common actually.

  4. Yes you are the sort of customer that shops  hate..  Why buy things then take them back?   OK if they are defective  or wrong size,   but why did you return them... Change your mind,,, wanted the money cause you were skint or what...  Yes shops can make their own rules  unless there is a defect when the sale of goods act will apply.. Next time make up your mind much sooner.   or don't buy in the first place...

  5. I am in the retail business and i assure you its perfectly legal. The store i work at does the same thing if the item has gone on clearance.

  6. Unless the item was faulty or not fit for the purpose it was intended, the shop is under NO legal obligation to refund OR exchange.

  7. Yes, it is legal, since return policies are set by the individual stores.  Some stores don't have any return policy; the law has nothing to do with it.

  8. If you have a receipt they should give you store credit for the amount you paid for the item.  I think they can only give you less if you don't have your receipt and then they give you whatever they sales price is on the day you are returning.

    Under the 1979 Amended sale of goods act. section 14.

    The goods were suitable for the purpose sold, they are not damaged or faulty in anyway. Your contract of sale was binding. They could have quite legally refused to do a thing about it. By offering you an exchange they have exceeded their obligation to your statutory rights. You can choose to accept the offer or not as they are not in breach of contract.

  11. Yeah,  it's up to the store's policy.

    Clothing is a "soft' line, meaning it goes bad, gets old & out of date, so it is very common for clothing stores to have these kinds of policies.

  12. Pop the stitching and take it to another branch and say its faulty.

    Trust me, they dont have any option but to refund you then.

  14. As long as this policy is stated either on the receipt or instore than it is legal. If you ask for a manager they normally will give you the refund anyway, and just let you know that they don't normally do it. If the items haven't been worn, still have tags and a receipt, then I should think the manager will take it back.

  15. Yes, it is legal.  The goods were not faulty or 'unfit for purpose'. So, it's up to the store whether they accept goods back or not.  Some Companies are realistic and believe it's important to keep customers happy (M&S) whereas others have less generous policies.  No retailer is obliged in law to give refunds/exchanges on goods that are not faulty.

  16. Lagally a retailer only has to give a refund if the goods purchased are either faulty or of inferior standards,,,,They don`t even have to give you a refund if you change your mind,,,most do just for the PR bit,,,good customer relations,,,
