If there was a person in jail who was about to be released soon, but then attacked and beat up a prison officer, how long roughly would the sentence be extended?

  1. 5-25 years.... aggravated assault on a public servant.

    It wouldn't be EXTENDED, it would be a new sentence.

    You can't extend a sentence.

  4. Just like any other charge go to court plead not guilty be released on personal recognize or post bail and he is free until the trial.He may lose any good time he has earned while he was in there and that will delay his release depending on how much time he had earned off his sentence.

  5. If it helps at all, a simple assault is 6 months minimum. Aggravated assault ( using a weapon) is up to 4 years and felonious assault ( causing permanent physical damage) can be up to 20 years. This is maximum sentences and can vary greatly by state statute.

    I live and work in Ohio. Due to the number of assaults on staff in prisons, under Ohio Senate Bill 2 of 1996, the minimum sentence for striking a Corrections Officer is now 3 years as a felony charge.

    Also, as noted above, no sentence is "extended". This would be a new charge levied against the inmate. He would go through the normal booking procedures and stand for a new trial. He would be segregated from population (isolation) and an administrative transfer would be made to remove him from the prison where the Officer he attacked is working. For the remainder of the inmate's life he would have an active separation from that Officer.
