Ticket for failing to yield after a stop?

2 days ago a car hit me, I was ticketed for driving without a license, and failing to yield AFTER a stop.... the lady told the cop I ran the stop sign, but I said I didnt so they gave me that ticket to I guess "compromise". My dad went to see the video from a hotel on that street and you can tell the lady is going way over the posted 25 Mph. So couldnt I fight the failing to yield because SHE was the one speeding, if she was going the speed limit we would never have had the collision... I know this doesnt look good for me since i was drving without a license but what do you guys think?

  1. Its not fair, but they will always see that because you didnt have a license  "you shouldnt have been there anyway"

    its generally difficult to overturn a cops decision, but good luck if you try.


  2. Was it a four way stop?  If she didn't have a stop sign, regardless of whether she was speeding or not she had the right of way.

  4. If you had a stop sign, and she didn't, you won't win.  You have to yield to through traffic.

  5. No. Failing to yield is the primary collision factor. Besides, the party with no license is automatically at fault in my book.

  6. You are going to hate me.  But, here goes.  If you weren't driving illegally without a license there never would have been a collision.  Same with if she weren't going so fast - there wouldn't have been a collision.

    So, the question is..which is the bigger offense?  Speeding or driving without a license?  Driving without a license is the bigger offense.  And if you had a license you would know that a speeding driver doesn't give you the right to pull in front them and cause a crash (I know it was an accident).  Even if you stopped at the stop sign - you still have to yield the right of way to the vehicles that don't have a stop sign (doesn't matter how fast she was going).

  7. if you had a stop sign and she didn't, then you probably won't get out of the ticket.  At a stop sign you have to stop and yield the right of way to any car that does not have a stop sign... it doesn't matter if they're speeding or not.  It just sounds like you are a bad judge of speed.

    I know this isn't what you want to hear, but its the truth.

    if you look at it from your point of view... yeah the accident wouldn't have happened if she wasn't speeding, but the accident also wouldn't have happened if you weren't driving.  Driving without a license is a bigger offense than speeding... so yeah, still your fault.

    Besides, they can't prove her speed from a tape... unless there are those white lines painted across the road at some point that cops use to catch speeders.  I forget the name, but its something like vesra or something else that starts with a V.

  8. you should not have been driving without a driving license do you have a permit? you should have been driving with some one who had a license maybe then you would have had a better chance of this not being YOUR FAULT  get a permit i if you were to have an accident at least the courts will look  at BOTH SIDES of the accident

  9. its your fault regardless of what her speed was your offense is more serious than a speeding violation being unlicensed means you have no experience behind the wheel
