Ticket for running a red light in GA?

My husband got a ticket tonight for running a red light. He said the light turned yellow while he was under it. The cop pulled my husband over, but not the car behind my husband who also ran the light. My husband told the cop that he saw the light turn yellow while he was under it, but the cop said he was giving him a ticket for running a red light. What is the process of fighting this ticket? Is it worth fighting? Does it cost money in GA to fight the ticket? Please only answer if you know GA laws.

YES YOU MAY CAN BEAT THIS TICKET IF YOU GO TO COURT BUT THEY THINK YOU WILL RUN UP THERE AND PAY THIS MONEY AND NOT TAKE IT TO COURT SO IF YOU GO TO COURT AND EXPLAIN JUST WHAT HAPPENED ABOUT THE DRIVER BEHIND YOU I THINK THE JUDGE WILL DROP YOUR CASE ..GOOD LUCK I AM FROM DOUGLAS GA. During the court date that is written on the ticket, your husband will enter a plea of not guilty if you would still like to fight the ticket.  He would then be given another court date.  That court date would be where he comes face to face with the officer in front of a judge and is able to cross-examine him.  You would present what evidence your husband may have.  At the end of the trial, the judge will make a determination on if he did commit the violation or not.  If he is found to have committed it, then he must pay the fine plus court fees.  If he is found not to have committed it, then he gets off without anything against him.  

    If you have any evidence, then talk to the state's attorney office, present the evidence, and you will either have the evidence admitted in court, have a court date for the admissibility of the evidence, or have the charges dropped altogether.  

    If he believes he is innocent, and can prove in some way,  then go and fight it!

  4. Oh dear, I'm so sorry. As a lifelong Georgian, please don't blame the residents of the state or assume the local cops represent the views of the people.  Most Georgians can tell the difference in yellow and red, but apparently, they don't check this skill with potential peace officers.  My husband got stopped for doing a U-turn at an intersection that is built specifically for U-turns.  While he was trying to explain road construction and lines on the pavement to the cop, about six more cars came through and did the same turn.  The cop finally admitted his stupidity and they drove off.  

    As far as the red light ticket, I'm going to be honest with you.  In more jurisdictions, the cops have absolute say so with the judges, unless you have a witness.  I would suggest going to see the judge prior to the court date and calmly telling his side of the story.  With no prior records, sometimes you can get a judge that will listen.  Good luck.

  5. Had you been traveling at the correct speed you would have been able to stop in time. If you fight it, its your word against his and he is the law so you don't really have a fighting chance.
