What are some of the criminal cirumstance that determine weather a person is held with or without bail?

  1. To put this another way, when a person is arrested and charged with the commission of a crime, a Judge is going to determine whether the person charged is likely to be a menace to society ( in more serious cases) or is likely to try to avoid prosecution and not return to court for trial.

    The more serious the crime being charged, the higher the amount of bail that is set. If the person cannot afford the bond, then they remain in jail pending the start of their trial.

    Domestic violence, murder, armed robbery, violation of a restraining order, assault with a deadly weapon...are just a few that require you to go before a magistrate before a bail can be set.
