To get a restraining order against somebody?

Its somebody at work, my superior.Do i need a lawyer to get a restraining order or I can get it on my own? Where do I start? Thank you

  1. it s very easy , go to the police and ask ... the problem is that the person will have the right to answer and can complicate yourself if you have no prove or he s not stalking you...


  2. Restraining orders are EASY to get without an attorney.  What state are you in?  and a little background on why you feel you need the TRO?

Here is what I tell people when they call and ask the same question of me at work.  The best way to obtain a restraining order is to contact an attorney.  Yes, you pay money, but they will be able to argue your case better (if necessary), ensure everything is covered in the order (there is a lot if you have never seen one) and they will make sure the local Sheriff's Office (depending) gets the individual served.

    You can contact the court directly and ask them how to go about drafting and filing a restraining order.  If your local courts are like ours, they won't provide this information to you over th phone because they somehow view the proper procedures for filing as "legal advice.

    So, my suggestion would be to try and contact the courts first to see what they tell you.  If they give you the run around, contact an attorney.

  4. There has to be a reason to get the order. Such as harassment or threats to your life.File a police report then take a copy to the local criminal court and request a restraining order. If it's a manager at your company go to his/her boss and file a complaint. If there is a human resources department file a complaint with them. If it's sexual harassment that's illegal and you can go to your local labor board.

  5. If you go to see a lawyer, although this is not necessary, look for one offering free legal advice as they will be able to asses the situation and advise you on what to do and whether a restraining order is available.

    You can get a restraining order by going to court and applying for one.

  6. getting a restraining order is easy but how is that going to work out for you on the job? i can see a lot of bad possibilities there. have you tried all the avenues within your organization? i wpuld exhaust that avenue first. having an order on someone within the company will mean someone will probably get let go - him or you.

  7. You need to talk with a lawyer on this one: first what is the basis for the TRO? Next a TRO means neither one can come near the other, so what does this mean for your job? The company will most likely back the supervisor esp. if you failed to follow company policy in regard to reporting your supervisor, so does that mean you are out of a Job? I am not sure thus the reason to talk to a lawyer

  8. you need to see a solicitor, go to court and the judge will grant one (in U.K.)costs £3500, must be good reason for this, probably easier just to change jobs.
