To start my own Diaper Cake Business do I need to patent it? ?

I am interested in starting my own diaper cake business, but I do not know how to get started. If anyone can give me some info I would greatly appreciate it. I dont know if I have to patent the idea since it has already been done. I dont want to get sued. Please help.

.   It is not a patented idea.  Go ahead.  Just spread the word and offer cheap prices in the beginning.  Call the local newspaper and see if a reporter will interview you about your new business.
