hello friends to the north,

my hubby and i were debating about the legalization of marijuana. i heard that canada has a personal possession law, how does that work? also, does that mean if they drug test you, you can have a small amount in your system and it's fine? or do they even drug test?

They do drug tests and if you have a small amount i think it's okay but i wouldnt take very much...

My advice is when crossing the border you do not have any of the stuff on your or in you.   Customs frown on the possession of the stuff as well as trafficking and use...not a good thing to try and bring over.

The use and possession of small amounts of marijuana is still illegal BUT, jail sentences and criminal records have been replaced by fines.

If they test and find it in your system it is NOT okay because it is illegal.

Possession of maijuana is illegal, but small quantities (considered "personal use") won't normally land you in jail.  It's really up to the arresting officer if they feel you should be charged with possession.

Charges for possession are based on actually finding a physical quantity of drugs in someone's possession.  You cannot be charged with possession from a drug test.  Drug testing is not used in law enforcement.  Typically, drug testing is used by employers in high risk industry to ensure their employees are not under the influence.

What Doug mentioned in his answer is quite correct. The only thing I would add is that if you were doing drugs of any kind and were involved in a traffic accident, if the police suspect you are under the influence of drugs or alcohol, they will administer a sobriety test. If you fail that, you are likely to be taken to the station house for DUI.

I have been told that the police are allowed to arrange for a blood or urine sample to be taken so they can confirm the presence of drugs or alcohol, to further solidify the case against you. Unfortunately, I cannot verify that at this time.

One thing I can confirm: If you are applying for certain jobs here in Canada, employers are allowed to  make mandatory drug testing part of your contract for employment. It may be a one-time thing to get you the job, or may be required periodically, or randomly.

There is no law in Canada that permits the possession of marijuana: the only two exceptions to this are the usages of marijuana for medical purposes and for non-medical scientific purposes. Read "government approved" between the lines of both purposes and usages.

There is no "personal possession" law per se in Canada. Any amount of marijuana in a person's possession is against the law except for the approved purposes mentionned above. I have heard about this "urban myth" from my cousins in New Jersey.

So what is the truth. Canadian police have changed their focus from going after ordinary users to distributors and criminal organizations. This re-emphasis started more than two decades ago. As a result, people caught with small amounts of marijuana in their personal possession - say less than an ounce - have often been allowed to walk away and not be arrested by the officer or officers involved.

Why? Frankly, the public was tired of seeing the police arrest so many users and so few traffickers. Arresting the users really does nothing but inflate police arrest sheets without doing anything to stop the flow of marijuana. It made the police look good, but did nothing to rid the community of what many thought of as a "drug problem."

Anyhow - CAUTION (1) - even if caught with a small amount, even if they let you off with a warning, the police will confiscate your stash and paraphenalia. CAUTION (2) They can still arrest you if they want.

As far as drug tests go, in Canada, you are more likely to be tested for alcohol levels. I know of no standard test for discovering marijuana in your system by the police, yet. That doesn't mean the police might not get hold of medical records - one way or another - say, if you were in a driving accident or something else of a serious nature.

A bit of information for the Candians on here.........

Each Province and Territory has it's own Highway Traffic Act, amd all of them have a section about "drving while impared " and most people don't know that section can be applied for  "drugs " as well as "alcohol ".

  Driving while "high " or "stoned " is a illegal act. and upon conviction you will get the same sentence,  one way or the other.

Any one who works in a job that is "federally regulated  " such as the railways, or the airlines,  or the CF or the RCMP, is subject to random urine testing, and if it shows positive for either drugs or alcohol, you are in  trouble.

There are laws against possession, but this is not really enforced. The police have better things to do...if you have a small amount, you will be fine.

Personal possession is for those who are dealing with the after affects of cancer treatment and use marijuana for pain relief.

It's not ok for us to walk around with a small amount of pot on our persons...not yet anyways!
