Tourist at UK allow to give birth there?

if i am a tourist at UK and then i get pregnant it is allow to give birth there and is there any chance for my baby to be a citizen?

  1. If you're a tourist in the UK then depending on your nationality you may not be able to give birth there. Eg if your nationality is of the EU (most of their countries especially the ones who entered the EU before 2004) you will be able to stay in the UK under treaty laws. But most tourists will only be able to stay in the UK for 6 months or depending on how long their visa lasts. Being pregnant will not give you an automatic right to stay in the UK unless you make arrangements with the Home Office and have a letter from the doctor stating you are unfit to travel.

    Since you are in the UK as a tourist then you won't have permanent residency in the UK. As a result your partner will need to hold this or be a British citizen in order for the child to obtain British citizenship. Failing that the if the child is born in the UK and lives there to the age of 10 you can file for British citizenship for them. This is automatically given provided that it can be proved that the child has the UK as it's main residence and does not spend above a certain amount of days outside the country per year (see first link).

    There has been a case where a Cuban woman gave birth to a child in England (father was British) but according to the British the child is not British (despite the father's nationality) this is mainly because the parents weren't married at the time of birth (second link). Though after an appeal (with the help of their MP) the child was allowed British citizenship (third link).


  2. I agree with Alex_F even though I really have no clue.  I doubt they will kick you out just because the baby is about to be born.  That has nothing to do with citizenship in most countries.  We need to amend the US constitution to correct our issues in that regard.

  3. 9 months is a long time to be a tourist.... However if birth is eminent I can't see how they could prevent it...

    Your baby will NOT be a citizen (at least one parent must be a UK citizen for a child born in the UK to be a UK citizen).

    However, if you acquire Indefinate Leave to Remain and live in the UK for 5 years after the birth of your child, then he/she will be a UK citizen.

    In short, he/she will NOT be a citizen unless you live legally in the UK for a specified period of time after his/her birth.
