Tourist going back to the states with his US citizen baby..?

i have a US citizen son which happens to be a medical baby.. i only have a tourist visa.. im planning to go back to the states with my son with a feeling that i might be deported when the immigration knew i took advantage of the government.. medi-CAL is in california only, right? im thinking if i exit through NY or NJ.. will immigration still ask whether my son is a medi-cal baby or not? wherein he has a blue passport and me with a tourist visa only.

  1. Your son's passport is going to show California as his place of birth so it doesn't matter if you exit from NYC or Miami or Brownsville, Texas.

    You're right to believe that you might be refused admission because of your previous stay in the U.S.

    In order to receive Medi-Cal, one must be a resident of California. A California resident is someone who lives here and plans to stay here, or someone who is working or looking for work in California.

    When you applied for Medi-Cal, you indicated that you lived in California and that you intended to stay there as a resident. The truth was you did not have a green card, and you were not a legal permanent resident.

    It would not be very hard to conclude that you took advantage of a benefit only available to residents when you were in the country as a visitor. Therefore, you must be a resident without a resident visa.

Your child has a right to citizenship in your own country of citizenship.  Bringing this child here for medical care means you will never be able to immigrate legally to the US due to the "Public Charge" law -- use of public funds, charities, etc. makes you ineligible for immigration or citizenship.

    You are just another abuser of the American taxpayer.  You come in here to have a baby to get it a passport and squeeze money out of the taxpayer.  And you fail to consider that this child could be harmed by constant travel when it needs medical attention.  It would be easier on the baby if you stayed in your own country and get medical care there.  It would also be much cheaper.  You can afford all this travel back and forth, yet cannot afford medical care?  Cheater!

  4. i am not sure what you mean by medical baby...how did you take advantage of the govt? i think whether or not they deport you would be based on the 'personal' info. that u left out.
