Say a transsexual killed somebody and got sentenced to prison for life. Would they get put in a prison for the gender they are now or the gender they were born as?

  1. If they have a p***s, they are going to a male prison.

  2. born as (if they still have the "parts")

  3. It depends. In Australia I understand it is the gender you were born as and you are segregated for your own protection in a seperate wing.

  4. s*x=s*x of the body

    Gender=s*x of the brain

    Post-op transsexuals are put in prison of their reassigned s*x.

    Unfortunately the rest of transsexuals have to suffer, even if well on HRT and pass very well etc, they are put with their birth s*x. It is difficult for a transsexual prisoner to obtain hormones at the proper amount along with any necessary psychological needs while in prison.

    This is really really really awful, especially for transsexual women. If you put a transsexual woman in prison with MEN, then not only would she feel out of place and like total c**p, she would be inevitably raped and abused. Even if she is in a separate cell, she will miss many opportunities and rights.

    Prisons depress me. This is why I'm never going to do anything that will get me arrested.

  5. You might want to check out a documentary on trans women forced to go to mens' prisons entitled, "Cruel and Unusual"  Unfortunately, with a lot of backwards thinking still left in society, trans*people will often be sent to prisons that do not reflect their gender.

  6. I agree with unlucky

  7. It would make sense that it'd be the gender they are at the time.

    However... knowing this country's laws and the degree of their stupidity (sometimes)... I wonder.

  8. Depends on where the crime was committed.

    My Uncle in the UK is a prison warden who's worked a whole slew of prisons. Each one he worked in where they had inmates who were trans, they were living in a separate part of the prison, away from the general population so there were no incidents associated with hate crimes directed at them. I guess if they are sent to a male or female prison is probably determined at sentencing.

  9. I was arrested once.  I'm a female-to-male pre-op transsexual.  Although legally on my driver's license I am listed as male.  Don't ask.  It just kind of happened.

    Anyways, when I was arrested, I was put in a women's jail.  It was SO humiliating.  I even have a BEARD!  I was there for 10 long, excruciating days before someone finally bailed my a** out.

    I was made fun of by the police, saying that "well you need to shave because you look like a freak", and "hey guys! Did you get a look at that chick in that cell over there? She looks like a dude!" SCREAMING this across the holding cell area.  I had people "mooing" at me (I'm guessing in reference to bull d**e? I have no idea what that was about) . Yeah, it was horrible.

  10. More then likely it would be the one that they are living as.
