Transfer fees charge in case of aparment deed

Hello,

I have recently purchased a re-sale flat in Pune (Maharashtra). When the final deed of the apartment happened, the society hadn't been formed yet. In fact the society isn't formed yet (as of today). The earlier owner had executed the Deed of Apartment a couple of years back and I have also got the final (Apartment) deed executed.

The society is not yet formed and is currently in the process of forming one. The body is elected and they are working with builder for the transfer. The elected president of the society is demanding the transfer charges as I asked him to change the name of the owner as in their records. As I understand from my lawyer, with the Apartment deed executed, the demand of transfer charges is illegal. I wanted to know if any such transfer charges shall be paid to the society.

  1. I am not sure what a Deed of Apartment or final deed is.

    Every society fixes Transfer Charges in case of re-sale of flat in the 1st AGM, and the max. amount chargeable is Rs.25,000/-


  2. The demand of transfer charges is not "illegal".  You just won't be able to collect.  YOu needed to do that before the final deed. /
