  1. If you FLY to Mexico, you MUST have a passport.  If you go by LAND or SEA , you do not need a passport yet...no date has been set for implementing that part of the law.  see site below and read top half of page carefully for current info.  For LAND travel, you need a photo I.D. and proof of citizenship...like a passport OR a birth certificate.

  2. I'm not entirely sure how it works, legally-speaking, but I believe that would depend on the way you enter Mexico - I live in Cd. Juarez, a city across a Texan community, and Americans cross by land all the time without anyone asking for their passports. It's a different matter when you enter by air (and maybe even in commercial buses), for which you ARE required to show a passport when you get off the plane. However, what does apply to all situations now is a law recently approved which states that all Americans citizens are required to show passports upon re-entry to their country - not just ID or birth certificate, but a passport. So, if you enter Mexico by land (on your own, no commercial buses or anything), you might get away with no passport while in Mexico, but when you try to get back to the US, your own CBP and immigration agents will ask for your passport.

    Hope that helps.
