Question:

Tree limbs hanging over in my yard...can I cut them down

The neighbors have two big trees and some of the tree limbs hang over into our yard. They are constantly making a mess in our yard and we are constantly having to clean our back yard and pool. My husband cut the limbs that were hanging into our yard yesterday....only if they were on our side...we did not touch anything that went into our neighbors yard. The branches that fell into our yard my husband cleaned up and threw away. Some branches must of fell into the neighbros yard...this morning I wake up and they threw over all the branches that fell into the yard back over into our yard. My question is can we cut the tree limbs that are hanging into our yard? I want to just throw the limbs that the neighbors threw back over into their yard but I heard that you are not allowed to cut a tree not belonging to you even if it is hanging over into your own yard....anybody know anything about this.

  1. if you speak to your neighbor and they do not clear the problem, i think you can cut the branches that hang in your yard. haul away the branches that you cut, if your neighbors are so hard to deal with, haul off what they throw over, if you cut it


  2. yes you can remove any thing that is on /over your property.and you should make sure all is cleaned up. if the neighbors toss it back over it,s still your job to clean it up.(tip)before you cut/trim tell your neighbor and ask if you can come on thier property to clean up .it will save you a lot of problems and if they refuse.well at least you asked and proved your the better person.good luck

You are allowed to cut branches that hang over the property line into your yard.  You are not allowed to do anything that would kill the tree.  But feel free to trim away.  Do they think the tree is on your side?  Weird that they threw the limbs into your yard.  Each person should take care of limbs, leaves, whatever that falls on their side.

  4. Yes you can, if it was an Apple tree you could pick and keep all the fruit on your side, same applies to the branches.

    So long as you go straight up or even a little on your side of the boundary it's fine. I don't think it's good to keep tossing branches around, if they throw them over to you, shread them and put it on your plants or compost bin them, (chop up first).
