Trespassing Question?

Does the sheriffs dept have to issue you Miranda rights when taken into custody for over 12 hours without a statement for trespassing as a pedestrian then issued a citation for being on public sidewalk after the person asked me to leave their property that had a fence.

  2. No, they don't. A peson needs to be advised of their rights if there is a custodial interrogation. The person needs to be in custody and if the police are going to ask questions designed to elicit an imcriminating response then you must be advised of your rights

  3. nope i was put behind bars once and not mirandized..i thought they had to read you your rights and asked an attorney and he said the cops dont always have to...

    you cant fight the law or the citation on this one...sorry...
