Trouble going home to my husband and stuck in canada with our daughter can anyone help?

i was born in canada in 1983 and have a father that is american according to my reserch i am an american citizen born abroad.I went to florida to live in2003 and met my husband an american had an american baby. When i returned to the country i was born in to see my mother and sister for christmas i was returning home to florida and was denied entry into the united states because they wanted proof that i am an american.I have been now in canada for 5 month and cannot return home to my husband i have gone to the cosulite and they want proof that my father lived in the united states between the years 1945 and 1962.Thats a problem for me because i lost contact with my father when i was little.I managed to prove where he went to school untill he was 16 i have the proof that he is my father and that he and my mother were married but it never enough for the consulit.I really want to go home my daughter needs to see her father help me help me

  1. I'm sorry you didn't try to get advice on your immigration situation before traveling.

    Everybody above has written accurately. Your proof of U.S. citizenship is hazy. And since your closest connection to the U.S. (your daughter) is there with you, there is no chance that they will let you into the U.S. just to go and take care of her.

    The first thing you need to do is try to get a K-visa which is odd since you're Canadian. I'm not sure Canadians require a visa to come to the U.S. When you get into the U.S., you must not leave. Immediately have your American husband file for Permanent Residency for you. You should be fine until you get your documentation together to show that you're a U.S. citizen.

    Ask your husband to come to Canada to see you immediately. It is the quickest way your husband will see his child, and vice versa.

    Act quickly, before things become more complicated.

  2. You need the appropriate proof and a knowledgeable immigration attorney, not Yahoo Answers.  At best you will receive a suggestion that your husband visit you in Canada.

    Edit:  A US citizen is not eligible for a US visa.

    Since your father was your only US citizen parent, and you were born before November 14, 1986, he must have had ten years of physical presence in the US, five of which were after reaching age 14, in the United States or its outlying possessions in order to pass on citizenship to you.  There is no way around the law, as you have learned.  It's a shame your parents didn't take care of this when you were born - it would have been simple then.  You and your mother need to find your father and get him to help you, or else figure out where he went to school and request his records.  There are no exceptions to this law.

  4. You are only a US Citizen if your US Citizen parent lived in the US and you can prove it.

    Apparently, you can not prove it.  However, you husband can petition for you to come to the US under a K visa and then a Green Card and then Citizenship.

    Take the easiest and cheapest route K visa!

    You do realize your proof of parentage and the residency of your father is not necessarily sufficient for the US government?

    and since you were in the US  ,did you have permission to live in the US ? did you have a green card ? did you not apply for residency in the US ?

    why has your husband not apply for a # petition for relatives # ? form: I-130 for you and your daughter ?
