Trouble with current landlord.?

My husband and I are having a difficult time finding an apt. Because of our past rental history and our landlord stating that we had slow payments in the past. We are not behind on our rent and have paid all past rentals that we owed money to. What can we do on our behalf so that we are not tuned down constantly for a place.

The other reason why we are being denied is because our current landlord is saying that we have had slow payments and that he would rent to us again, but he is also trying to hold us in the house we are renting because he is paying a mortgage with the rent money that we pay monthly. Can he do this? What can we do to stop this and find us a cheaper place to rent from? PLEASE HELP

  1. When is your lease up with the current LL?  He cannot hold you in the house if your lease is expired you can move out anytime with adequate notice he cannot force you to stay if you don't want to.  You can explain the situation that your current LL is making it difficult for you because he doesn't want you to move out, now if you were such horrible tenants why would he be trying to sabotage your moving??? explain that to them tell them that you have paid late 2x in the past but have made sure that you've been timely from that point forward, explain that he won't give a good reference in the hopes we will get turned down from whereever we apply and so far this has been happening.

    If this doesn't work send a nice letter to your LL and explain that you are moving out and if he continues to sabotage your efforts to secure other living accommodations you will take him to court and sue for damages.  Maybe he'll think twice next time someone asks him for a references.

  2. File a civil action against the current land lord.  You can do it in small claims court (cheapest <$180 - does not need an attorney).

    He will stop answering payment questions from perspective landlords, and you will be able to recover damages (if you get an affidavid from whomever told you that he is reporting slow pay.  Be sure to have proof of your on time payments when you go to court.

  3. Show them copies of your bank statement to prove you are timely with your rent.

  4. Yes, He can give rental history i.e payment history and would he rent again. There are limits to how much he can say. I would google landlord laws/ tenant laws.
