Trouble with ebay and paypal?

I sold a laptop on ebay the buyer paid by paypal but after a few days started a dispute saying he hadnt received it,and that i hadnt emailed him with his Q's,i emailed with in the hour.Paypal froze the money then in the end said he had won the dispute and gave him his money back! so i am now without a laptop or the money! ive been robbed basicaly its Theft i think.Could anybody help me with any ideas on what to do now.

  1. I assume that due to the value you posted and had the parcel insured? If so you should have claim with Royal Mail eho whoever you used. They should then have a signature from the person who signed for the laptop.


  2. Since this question is in the Royalty section, I will assume you are in fact a member of the royal family.

    If this is the case, can you not just have somebody beheaded or some equally royal privilege bestowed upon the prat that swindled you.

  3. OK,

    the crux of the matter is, did you use a postage service that proves delivery e.g. Special Delivery, Recorded Delivery? If not, then you've fallen foul of the most basic of rookie errors.

    If you sell anything and accept paypal, always send as Recorded Del as a minimum. Otherwise, a buyer could pretend not to have received, and you have no proof otherwise. If you do have proof of delivery, then Paypal should not have found in the buyer's favour.

    Alternatively, it's is possible that the buyer genuinely hasn't received it, and you should contact the post office. Even without tracking, they'll look into it, although the chances of them finding it are much less.

    Unless you are able to prove that he's received it, there's little chance of pursuing through the small claims court. As a seller, the legal onus is on you to ensure the item gets there safely.

    Another option may be to actually phone up the person and discuss. If they're willing to chat, they're probably genuine. If not, maybe they ARE pulling a fast one.

  4. I had exactly the same problem as you about 3 months ago but with a camcorder not a laptop. I sold it and the "buyer" claimed it was an unathorised payment after he had signed for it's delivery! Paypal just gave the money back to the "buyer" even though he was a known conman on ebay. He had a feedback of 100% and 30 ratings all of which had benn conned. Both ebay and paypal knew about him but did nothing and couldn't have cared less. I have now cancelled my paypal account and only pay by cheque now.

  5. we've had the same problem too. if you had the money in your paypal account i don't think there is anything you can do as he probably has his money (and your laptop). if there is no money in the account then just change paypal accounts like we did so then he can't get the money. nothing further has happened with ours. basically you have been shafted which seems to be the norm on ebay and paypal these days.

  6. your dispute is with ebay, not paypal.

    this is why I don't deal with Paypal as they owe me $$$$$$$$$.

    Put down on your ebay (Money order, cashiers cheque, personnel cheques only) NO PAYPAL.

  7. Ever since ebay took over paypal this kind of c**p has been happening. I sold on ebay without any problems for 3 years then they bought paypal and things got changed.

    There is nothing you can do about them freezing your money. Or the fact that you are out the laptop too.

    I quit accepting paypal from my buyers and lost a whole lot of buyers. Then ebay raised their fees AGAIN and I said the h**l with it and quit doing ebay all together.

    It was a great source of income while it lasted. It's too bad they got so greedy.

    I wish 20/20 or Dateline would do an investigation into ebay and paypal.

  9. Unfortunatley...if you didnt get proof of postage then you are out of pocket....the post office would have reimbursed you for the lost laptop...even if it wasnt really lost (IE the buyer had lied)

    Next time get proof.

  11. you must have the persons address,contact them,do you have proof of delivery ie registered etc.you must have taken the parcel to the post office,follow the trail,if you find it has been delivered,take him to the small claims courts!!

  13. how on earth did he win the dispute with paypal?  Can't you keep fighting through paypal?

    I used to use ebay a lot.  I had one credit card that I only ever used on paypal.  we are told it is secure, but someone got hold of my card details and spend over £500 on the card.  I no longer use ebay.
