For the past 2 years the city has been trying to close north olmsted ohio skatepark but the thing is no skaters (like me) want it ever closed. The Property is privatly owned by Reann Thomas. So they cant close it right? since its private property. Also someone helped and cemented a rail in too make the park funner and added a vertwall is that illegal to do?

  1. The park can be closed down if it violates local audenence. For example, if the land is not zoned for a comercial or entertainment use it may be closed down.

I can't speak for the rail, but the vertwall can probably be classed as a fixed structure so it would have to have planning consent from city hall and would have to comply with both zoning regulations and local planning audenence. The park may also have to close if it doesn't have public liability cover. Or they may simply be forced to close because the cost of having it is too high.

In short, it doesn't matter whether it is on private property, only whether it is in compliance with the law.

Also, the park may have to close if presence generates a public nuisance. for example if local residents complain that the skaters bring with them litter, noise, or crime.
