Trying to get a security deposit back.. help.?

We were there for 2 years, the landlord needed us to move since he lost his current residence, we have left now and have been gone for 2 months. The property management company says the landlord has to refund the deposit since he took it? and the landlord is not responding to calls from them or me. If I got to small claims court who do I file against? We paid our deposit to the management company but they say the landlord took the deposit. Someone help. I have also been told the landlord is moving out of state, I have dropped of a letter and got no response. What should I do?

  2. Dont suck it up and move on

    Fight for your money. Sue for the loss against the property management company because your likely to get it back from them. They arent even supposed to spend it! Get 3% on top of that for interest and you may be able to get a sum of money for grief.

    Good luck and dont give up. you better act fast!

    Go talk to a lawyer immediately.  

  3. You sue the management company.   You gave them the deposit, it is not your issue/problem that they did not retain it.

    In some states you will receive 3X the deposit since they did not handle this correctly.   It is worth fighting for.

  4. I say suck it up, and move on.  I've heard of very few renters that ever get their deposits back.
