Turning right on a green light oncoming traffic turning left?

ok. I just got in a car accident. I was turning right on a green light, but a driver on oncoming traffic was turning left. I did not see her, because there are train signals, I guess she didn't see me, because she hit my the door behind the driver side. the officer didn't even know who's fault it was. I don't know. I just know she was telling me it was my fault, and her boyfriend was telling me it was HER right of way, but I don't know. help?

  1. yea definatly is NOT your fault if you turned on a green light

    because the only way she could have been making a left when you had a green light was that she made a left with out a green light arrow so either she ran a light or she could only turn left when it was clear so she totally wasn't watching very well cuz she hit you.

    and what a horrible cop if he didn't know who's fault it was.

    because its obviously not yours.


  2. If you were turning right on a green light and she was turning left. You had the right of way.

    You need to file a police report. If you don't, she can sue you and claim anything she wants.

  3. If you was changing lanes,unfortunately  you should have looked over your left shoulder before changing. You will probably have to wear most of the blame,even though she hit you.(unless she ran a red light at the intersection).

You were in the right lane turning right, she was opposite you turning left (also your right).  You have the right-of-way in this situation.  Get a copy of the police report and take her to court.  Also call your insurance company and inform them of the accident details.  They may want to sue this woman and/or her insurance company to recover repair costs to your vehicle.

  8. Since you were turning onto a two lane road there should have been no conflict. Turns are always made left lane to left lane, right lane to right lane unless signs and pavement markings indicate otherwise.

    If you are turning right, you must go into the right lane. The oncoming vehicle is restricted to turning into the left lane. In most states the left lane is restricted to vehicles turning left or passing vehicles in the other lane or lanes. In this case the oncoming vehicle would be restricted to turning into the left lane but would be required to move to the right lane as soon as it was safe to do so.

    Since you moved from the right lane (yours) into the left lane (hers), she had the right of way. You made an unsafe lane change and possibly failed to signal for the lane change.

    Based on the information you have provided, the fault is entirely yours.
