and her rottwieler chewed one of them up pretty bad while the other ran away only bit once. Now their mother is trying to sue my sister. Do they have any chance? They broke the kitchen window and were upstairs in the house when the dog got out.

Talk about retarded laws this country has.  This is called 'progress?'  Common sense says those two got what they deserved.  Except that they need jail time also.  They should also be forced to pay for the window and any emotional trauma felt on the part of the victim.  Ok.  Not the emotional trauma.  That's stupid.  But, if she has to take any time off from work to deal with this ridiculous scenario, she should be compensated.

As long as your sister had NO "Beware of Dog" sign posted, they have no defense.  They broke in.  The home invaders should be charged criminally, and your sister should counter sue the mother, perhaps even have her charged for custodial negligence.  Tell your sister to not stop, drive home the message and drive it home hard.

It would help more though if I knew what state.

Depends where you are.  Some states have castle laws that basically say you can do whatever you want to anyone entering your home illegally.

Others make the owner responsible for any harm, beyond the minimum needed to restrain the bad guys from hurting anyone.  The dog attack could fall foul of that law, in which case, yeah, she could be held responsible.

Sucks, but there it is.

yes they do...it sucks that the law in some cases protects the criminal more so than the victim.

They can sue but cannot win.  If she has homeowners or renters insurance, with liability coverage, she should notify her insurer.  They will defend any suit and if there is a judgment they will pay.

Depending on the judge, she could have to pay.  The law in cases like this, is not there to protect the innocent.  Your sister had better get a good lawyer.
