UK SPOUSE VISA for a US citizen - Please help?

I am a British citizen and my fiance is a US citizen. We are getting married in 5 weeks in USA. Right after our marriage ceremony we want to come back to UK and live here. As far as I understand he needs to apply for a spouse visa in order to live here. Our concern is that he will have to wait a long time before he will issued the spouse visa to come here. Does anyone know how long can this take approximately? I heard from anything between a day and 12 months on the internet. So please UNLESS you know for sure do not give any misleading information.

The info in the websites is very vague I need this info ASAP as I do not want any surprises when I get to US.

Could you also tell me if he can come visit me in the UK while his spouse visa is still pending?

  1. Your husband (to be) has file a spouse visa after you both get married.

    I have printed the actual website that gives full information regarding how to apply & what documentation would you need for his application.

    Since he is US citizen, he can apply for spouse visa & still can come to UK (as visitor) to see you (but wont be able to work or live long term) on visa waiver program between UK & USA. Once his spouse visa is approved he has to be in UK Embassy in Washington DC to collect his visa & then he can join you in UK for long term.

In all honesty this question is best asked to the Home Office's Boarder Agency as there are so many variables that can affect the answer such as if you are on Public Funds or if he has a criminal conviction in the US. The best we can give here is an approximation based on what you have posted. However the Home Office can give you the guidance that you are seeking.

  3. My spouse was issued their spouse visa from Caracas within half an hour - if you are approved I don't think it should take long at all but may vary from country to country. I would continue with your plans to marry as it sounds like everything is arranged. The most important thing is your visa application - it needs to be strong and include lots of information so that it gets approved straight away. If you have any concerns contact an immigration solicitor. We did and whilst it was expensive, we got the visa with no hassle whatsoever - they will also be able to tell you average waiting time for the US. Good luck - I hope all goes well!

  4. he will get an appointment to visit the embassy 3 months after the application is submitted. He will find out that day if it was successful. If there are any problems it could take up to six months.

    He can still come and visit you and you him.

    you will need proof of a relationship for your application. keep all records of phone calls, copy all emails etc, letters, texts, photos, ticket stubs from days out, birthday cards etc....

    your best bet would be to contact an immigration solicitor who will help you prepare your application. It may cost you a bit, but its not an easy process and in the long run he/she can tell you exactly what you need to do and prepare the mountain of paperwork you will need.

    Don't forget your certificate of no impediment from the UK register office.

    Edit: it depends on the embassy. My husband got his the day we applied. My friends husband had to wait 6 months. there is no upper limit.

    If by any chance your application is unsucessful (fingers crossed its not) my advice would be not to appeal, just apply again. they can have you tied up in appeals for years!!!
