UK Unbraked trailer law - do I need a data plate ?

I have read that an unbraked trailer under 750KG laden must carry a dataplate with its unladen weight indelibly stamped upon it.

However this information contradicts this:

Which is right?

My trailer has no brakes but no data plate of any kind.

Am I breaking the law if I tow it with my car?
