UK entry: was on working holiday, then studied - student visa expiring...?

i came to the UK on a working holiday, during which i met my (british) boyfriend, with whom i now live. when it expired, i left and re-entered as a tourist. after that, i enrolled on a programme and have been here on a student visa.

i'd planned to continue my course (and extend my visa, etc), but unforeseen circumstances have made it impossible to pay full international tuition fees for next term in the time required.

my student visa is due to expire very soon. our plan is to exit and re-enter, on a tourist visa.

the dates are very close (we'll leave 5 days before expiry, and re-enter 2 days after that). also i am concerned that although i've been here legally the whole time, the number and variety of re-entries will be suspicious to a visa officer.

we're going to portugal, and travelling through stansted.

  2. Impossible to answer without knowing what your nationality is, exactly when you first entered the UK on a working visa and the dates of subsequent entries to the UK.

There's one set of rules for EC citizens and another set for the rest of the world and even a few variations which apply to new members of the EC.

In principle though, you've clearly manipulated the process to stay in the UK longer than was originally intended. An Immigration Officer will take a dim view of this if you're found out and especially if you're found to have been working during any of your stays as a tourist. Also if you've worked over twenty hours a week or been self-employed whilst on a student visa you'll be in breach of your entry conditions and this also would weigh heavily against you.

See a good immigration solicitor in the UK.
