URGENT: Status Change from H1B to F1?

I had applied for an H1B in April 2007. My application has been approved by the USCIS. I have not appeared for an interview at the US embassy as the required documents would be mailed to me shortly.Meanwhile I got accepted for a program at a University In the United States and the I-20 form has been mailed to me.Now, I would now want to go to US on F1 visa. Can I appear at the US Consulate seeking F1 visa.

From what I know 2 different visa applications cannot be made in a period of 6 months.Please help.

  1. You choose visa type for which you wish to apply.  However, bear in mind that while you may take classes, part-time, while in the US as an H1B, you may not work as an F-1 except in very limited circumstances.


  2. Yes, you can appear at the consulate and apply for F1 visa.  Make sure you inform them that you have a pending application for H1B that you want them to cancel.
