URGENT! dwi charge in minnesota mn PLEASE HELP!!!!?

1. I had a previous dwi charge 3 years ago and pleaed guilty. (horrible I know but I have moved on)

2. AND I have stopped drinking since. The other night I had 1 drink (credit card receipt too) and when the cop pulled me over I got was freaking out and couldn't even blow right in the breathalysers. He was yelling at me the whole time.

3. He then took me to jail and get a urine sample.

4. I stayed in jail for 36 hours and then they let me go.

I AM SO VERY AFRAID! I don't know what to do, I am worried because I have not had much to eat that day.

WHAT CAN I DO NOW????

I have not been officially charged but I am sure they will try to.

THE URINE SAMPLE HAS NOT COME IN YET. How long will it take????

  1. Well, first thing is to hire a lawyer.  You are looking at a third degree DWI, which is a gross misdemeanor (due to the prior conviction).  You spent the 36 hours in jail awaiting formal charging, which is standard for all new GM and felony arrests.

    Did the officer get a urine sample or did you contact a Second Test agency?  That would determine the time needed to get the results back.  If the officer took the test in should be back within 2 weeks.

    Luckily you consented to the urine test, otherwise you would have been in jail for a 2nd Degree Test refusal, which would pretty much guarantee a third degree conviction, lawyer or not.

    Besides possibly hiring a lawyer, there is not much you an do besides wait and hope that your blood alcohol came back too low to be charged.  Good luck.
