Hi!

My cousin ( Italian citizen ) signed up to win the Green Card lottery thing, and this application form lasts for 3 years. Can she still go to the States for vacation during this time? Cause she was saying she wasn' t sure about it and they might not let her in the country.. can anybody help me?

  1. Probably yes, she can visit.

    A tourist visa is about having ties to a country outside the USA. In this case, it's likely Italy. (You didn't tell us her country of residence, her job situation, etc.)  

    If she has sufficient ties to Italy, she can visit. That she's put in for the green card lottery doesn't affect her ties to Italy. There's a good chance she can just use her visa waiver EU passport and stay for up to 90 days.

    When she arrives, someone will ask her what she intends to do, and what she does in Italy. Pretty straight ahead questions for a European gal to answer. Of course, economic ties to the USA could exist that you're not mentioning- is her husband here with all the bambinos? Is she on Italian welfare, hoping YOU will support her as an overstay?  

    So you see it's about economic ties to another country. If she's got 'em, putting in for the lottery won't change 'em, will it?


  2. Absolutely (as long as she is otherwise eligible for a non-immigrant visa).  The Diversity Lottery will not have an impact on her travels to the US until she is actually randomly selected for an immigrant visa.

Yes with no doubt she can travel to the USA with an Italian passport without any visa even during her green card pending case since she didn't get it yet, she can stay for 3months in the USA for each entry but once she receive the appointment for immigration visa she has to leave the USA and get her Visa from US ambassy in Italy since she is not allowed for adjussment of status according to the visa waiver program.

    Present the meaning of living like a credit card or debit and and a U turn airplane ticket is sufficient to be admitted at a US port of entry (airport) for an Italian citizen.

    (Without any ask of the attach to the country of resident she will be admitted according to the visa waiver program.)
