hello...I live in the Philippines. I just sent off my wife's I-130 about 2 weeks ago.

Now my question is, If she becomes pregnant and gives birth before she gets to the US how do we get the baby over there.

Do we need to file another I-130?

I have heard that we can got o the embassy and somehow the baby can get US citizenship?

And how long would it take.

  1. Only if you are a US citizen will the baby have automatic citizenship, and if that is the case then yes all you have to do is go to the US consulate there and report the birth.

and no you wont have to file another I-130 for the baby.the baby can be applied to your wifes I-130.call and ask a lawyer for details.

it will take between 18 months to 3 years for your wife to get her green card.

  2. If your child is born in PI you will need to fill out with the embassy consulate for a record of birth overseas.  You must be on the birth cert in PI, and it must be filed with NSO.  Have you wife pay extra side money to have this facilitated.  Then you will get a record of brth overseas from the embassy.

The bad news is that your baby cannot come to america until he/she has NSO documentation to prove the child was born, which can take 6 months after birth. Then once you apply for record of overseas birth another few months for the certificate.  Then filing time for a passport (not I 130), so this will push back yor wife's travel to US unless she leaves the baby with her parents.
